Federal judge rejects CDC's attempt to keep Conditional Sail Order in Florida

A federal judge denied the U.S. Centers for Disease Control and Prevention's request to delay a temporary injunction against the Conditional Sail Order in Florida.

The CDC appealed the decision for a preliminary injunction against the CDC's Conditional Sail Order which Judge Steven Merryday had granted in favour of the state of Florida.

According to the judge, the agency had overstepped its authority in imposing complicated rules for cruise lines to enable ships to sail again.

In denying the request Judge Merryday hit out at the agency

"This action is not about what health precautions against Covid-19 are necessary or helpful aboard a cruise ship; this action is about misuse of governmental power," the judge said.

"The CDC can show no factor that outweighs the need to conclude an unwarranted and unprecedented exercise of governmental power."
