Bill Munro was unfairly dismissed

Bill Munro, the founder of Barrhead Travel, has won his tribunal against Travel Leaders Group but will not be getting his job back.

An Employment Tribunal Judgment, released today, agreed that Munro was unfairly dismissed from Barrhead Travel but said it was not practicable, under terms of the Empoyment Rights Act, for him to rejoin the company.

It also ruled that Munro should not receive any financial compensation.

In a 50-page judgement, employment judge Lucy Wiseman noted there was a pattern with Munro agreeing to what was said or proposed by the Travel Leaders Group management team, but then doing what he wanted with regards to involvement at Barrhead Travel.

She said Travel Leaders had initially adopted a 'soft approach' with Munro but that in order to stop his continued involvement with Barrhead, his duties and authorisation were tightened significantly.

She also noticed that although there was no evidence given at the tribunal from Jacqueline Dobson, Barrhead's chief executive, Munro's reinstatement and his desire to involve himself in 'troubleshooting' and use the group's resources would 'create difficulties' for Dobson and 'create a tension' for members of staff who would be unwilling or unable to refuse his requests given his previous position in the company.

During the week-long tribunal last November, Munro had at one point broken down in tears as he explained that he had agreed to sell the company after discovering he had a heart condition.

The 75-year-old said he was diagnosed with an aortic aneurysm and feared he might not live very long.

He was given an ambassorial role by the new owners, but was then made redundant because Travel Leaders Group said he had been disruptive and had refused to let go.

Barrhead Travel declined to comment on the judgement. TravelMole contacted Travel Leaders Group for a comment but has not had a response.
