Virgin Holidays welcomes ruling on glass door accident
Virgin Holidays has welcomed a court of appeal ruling despite it finding the tour operator liable for a holidaymaker’s injuries.
Moira Japp, 53, from Worthing in West Sussex, accidentally walked into a sliding glass door at the Crystal Cove Hotel, Barbados in September 2008, suffering lacerations all over her body.
She argued that safety glass should have been installed and was awarded thousands of pounds in compensation at a previous county court hearing.
Three Appeal Court judges ruled that Mrs Japp was fully entitled to the £24,000 award for the accident.
But the operator said it welcomed clarification on the original ruling which had meant the industry was liable for the standards of works on buildings at the time of the accident rather than when they were built.
A Virgin Holidays spokesman said after the ruling:
"Although we regret the additional distress that this appeal process may have caused Mrs Japp, we wish to reiterate that we did not initiate it over an unwillingness to pay her damages.
"Our main motivation concerned the decision in the first instance where the date of breach was found to be the date of the accident. This represents a critical issue to holiday industry, and we’re very pleased we were successful in overturning this point."
