AirAsia vows to appeal PSC court ruling
AirAsia lost a legal bid against operator Malaysia Airports Holdings Berhad (MAHB) in a long running row over passenger service charges, but said it will battle on with an appeal.
Last week the High Court dismissed a Striking Out Application by AirAsia and AirAsia X.
It relates to an increase in PSC imposed by the operator which AirAsia deems as unfair.
MAHB increased the fee from RM50 to RM73 for Klia2 passngers, which is in line with charges at the main full service airport KLIA.
That is unfair due to the substandard facilities at Klia2 compared to KLIA, AirAsia says.
It has only been collecting the old RM50 fee for the past few months.
AirAsia says the increased fee is ‘a burden on all travelling Malaysians’ and plans to appeal.
"We would like to reiterate that these legal challenges are not simply a matter between AirAsia and MAHB. In the event we lose in the highest courts of appeal, it is the passengers especially Malaysian travellers who will have to pay the differential MAHB is charging," said AirAsia founders Tan Sri Tony Fernandes and Datuk Kamarudin Meranun in a joint statement.
"We believe that the people of Malaysia should have the right to a fair deal."
The airline also recently lost a bid to force a judicial review after the Malaysian Aviation Commission (Mavcom) refused to intervene in the standoff.
AirAsia also plans to continue pushing for Mavcom to make a decision.
