Low-cost airline wins court battle
Blackpool airport has suffered a humiliating defeat in the lawcourts after it lost a legal battle with Jet2.com.
The low cost airline has been at war with the Lancashire airport since it refused to allow two of its late night flights to land last October. The planes were forced to divert to Manchester.
The airport, which said it did not want to provide ground staff and emergency services after 9pm,  had also threatened to prevent the airline from taking off or landing outside of the airport’s published opening hours of 7am to 9pm.
Jet2 said the refusal was a breach of contract and took Blackpool Airport to court.
TYesterday the “sudden and unilateral decision to refuse to honour Jet2.com’s flights” was branded “a serious breach of contract” by his honour Judge Mackie QC.
He backed the airline’s case and upheld the initial contract between the two parties which allowed later landing times than 9pm.
He said: “It cannot be intended that BAL should be able to pick and choose what to do in light of what suits it financially.”Â
He added: “Low cost is of defining importance”.
Jet2 chief executive Philip Meeson said: “This is a great victory for our customers – Jet2.com is here to stay. We are delighted that our commitment to Blackpool and our dedication to maintaining friendly low fares have been recognised by the court.
“We look forward to a secure future of serving our customers from Blackpool International Airport – providing flights to a fantastic range of sun and city destinations at convenient flight times and all at friendly low fares.”
