OFT could take operators to court over security charge

The Office of Fair Trading is applying pressure to ABTA’s call for operators to include the cost of extra security in the price of holidays.

Following the 11 September terrorist attacks, operators were granted permission to make a separate charge for the extra cost of avaiation security – around £7.

ABTA has now decided that operators have had long enough to incoporate the charge. The OFT says says failure to include the Aviation Security Charges (ASC) in basic holiday prices will result in “enforcement action”.

The OFT said in a statement: “Failure to do so [include the ASC in the basic holiday price] will be considered a breach of the Consumer Protection Act 1987, which the OFT has the power to enforce under Part 8 of the Enterprise Act which came into force in June 2003.”

The Enterprise Act is aimed at protecting consumers from activities such as misleading advertising, misleading price indications, unfair terms in consumer contracts, and so on, and enables the OFT to obtain court orders.
