School teachers sue Delta over fuel dump

Four Los Angeles elementary school teachers are suing Delta Air Lines alleging negligence after being doused last week by jet fuel.

The lawsuit claims the pilots of Flight 89 failed to inform air traffic control they were going to dump fuel ahead of an emergency landing back at LAX.

The teachers from Park Avenue Elementary School in Cudahy are claiming they suffered severe emotional distress and had eye, nose and respiratory issues.

"Had the Delta pilot notified air traffic personnel of the need to dump fuel, the flight would have been directed to a location and altitude from which fuel could be released without danger to the plaintiffs and others," the lawsuit states.

It also claims a lack of adequate training at Delta in regard to safe ways to dump fuel during emergencies.

The teachers, who have not been named, are being represented by activist attorney Gloria Allred.

Nearly 60 schoolchildren and adults were treated at five elementary schools and one high school in the area.

The airline declined to comment on the lawsuit.

A FAA investigation into the incident is still ongoing.
