Travel agency wins suit over Internet domain name
A U.S. District Judge has ruled that a Miami travel agency was not unfairly competing or violating trademark rights by using an internet domain name which was same as that of a hotel it promoted.
Bavaro Palace, which owns luxury hotels in the Dominican Republic, had filed a suit against Vacation Tours of Miami for engaging in unfair competition and violating its trademark rights by using the Internet domain name www.bavaropalace.com to advertise hotel rooms.
Vacation Tours had a long-standing relationship with Barcelo Hotels & Resorts to reserve rooms at the hotel and used www.bavaropalace.com to market the hotel in their advertising and promotional campaigns.
The court ruled that Bavaro Palace had no legal claim to the domain name and its claims had no legal grounds.
Vacation Tours will now attempt to recover their fees and costs, which they are entitled to as prevailing party under the Florida law.
