Anti-gay slurs behind cruise ship death

The family of a man who allegedly jumped to his death  from a cruise ship have disputed the claim and intend to prove it in court.

The family of 35 year-old Brazilian Bernardo Elbaz said an altercation took place with crew members on Royal Caribbean’s Oasis of the Sea ship and he was subject to disparaging anti-gay remarks.

"Royal Caribbean is saying this was a domestic dispute and a suicide. It was anything but that," said Mike Winkleman, the Elbaz’ family lawyer.

Winkleman said Elbaz and his husband were subject to anti-gay comments throughout the cruise.

Royal Caribbean confirmed crew members were called to Elbaz’ stateroom but said: "Our staff did not have a physical altercation with the guest and were unable to prevent his jumping from the stateroom balcony."

"Royal Caribbean is deeply saddened by this event.  We will continue to provide assistance to the family as well as law enforcement.”

The Elbaz family is considering taking legal action against the cruise line.

Elbaz fell into the Atlantic, 27km east of Turks and Caicos, witnessed by other passengers on board who caught it on video.  

The ship searched hours before being joined by the US Coast Guard which included two boats as well as an airplane and helicopter crews.

The search was eventually suspended the next day.

The Oasis of the Seas was on a week-long cruise in the Caribbean.
