Covid source disputed in Ruby Princess class action case
The Ruby Princess class action court case recently began with the primary source of the deadly outbreak hotly disputed.
The outbreak led to the loss of 28 lives.
Defendants Carnival and Princess rejected the allegation the original source of the infection was a crew member.
The cruise line’s legal team want the plaintiffs to prove where the outbreak came from
Over 600 guests eventually contracted Covid-19.
Ian Pike SC, for the lead plaintiff said the line’s last minute demand to prove the source was too prejudicial.
The onus should not be on the plaintiff
“It can’t be allowed to be introduced now,” Pike said.
If allowed, an adjournment would be requested.
Pike argued the cruise should have been cancelled, particularly with cases on a previous sailing
“What occurred at the end of the voyage is not some accident, it was very likely to happen.”
“This boat should never have sailed and it was negligent to do so.”
The case is expected to last about a month.
