The US department of Justice has reached a settlement with a Japanese cruise line for damages over a crash into a pier in Guam six years ago.
The United States Attorney sued Japan based cruise operator Mitsui O.S.K. Passenger Line Ltd last year for $8 million damages.
The legal action also stated the captain of the Nippon Maru was under the influence of alcohol at the time.
The ship collided with the Apra Harbor in the Pacific US territory of Guam in 2018.
New documents filed at the District Court of Guam say a ‘tentative settlement’ agreement has now been reached.
“It is anticipated that the settlement process will take up to 30 days. Therefore, the parties jointly request the Court vacate the trial until the parties have filed the stipulated dismissal,” the U.S. Attorney’s office said.
The U.S. Attorney’s office alleged negligence by the ship crew, who did not keep in radio contact with the harbour tug.
The captain allegedly tested positive for excess alcohol, the lawsuit said.
“The willful and wanton misconduct of the master … in navigating the ship while under the influence of alcohol, entitles the United States to punitive damages,” the original complaint stated.
The captain of the vessel was later suspended.
The Nippon Maru also suffered significant hull damage.
The ship was carrying 524 passengers at the time but no injuries were reported.
