Malaysia Airlines, AirAsia win appeal to quash anti-trust fines
Malaysia Airlines (MAS) and AirAsia won appeals against RM10 million fines imposed for anti-trust violations. The Court of Appeal quashed the fines issued by the Malaysia Competition Commission.
It didn’t rule on the current validity of the allegations but reinstated an earlier decision by the Competition Appeal Tribunal.
Appeal judge Justice Hanipah said the Competition Appeal Tribunal is an appellate authority and the Malaysia Competition Commission must abide by its decision. The Commission said the airlines breached a market-sharing prohibition.
The airline collaboration agreement was actually signed before the Competition Act came into force.
