CAA win leave to appeal court ruling
The CAA has won its right to appeal against a High Court ruling that appeared to settle the controversial issue of dynamic packaging and financial protection.
The ruling in January gave agents the all-clear to sell dynamic packages without an ATOL, saving the trade an estimated £16.5 million in bonding.
But the CAA sought leave to appeal the decision, which has now been granted.
A full hearing will now be heard at a date yet to be determined.
The further delay in settling the saga will frustrate ABTA which was poised to issue official guidance to its members.
An ABTA spokeswoman said: “As this matter is still before the courts it is not appropriate for ABTA to issue general advice on the court’s decision.
“If members wish to discuss the impact of the case on their own business they should contact ABTA’s legal department.”
