Complete Caribbean
There has been some confusion as to the ownership of forward bookings made by agents with Complete Caribbean. We would like to clarify the position after seeking legal advice. As you know ITC purchased some of the assets of Complete Caribbean on the 19th October 2006 from the Administrators who had been brought in to find a buyer after the company had been refused renewal of their ATOL licence. The assets that ITC purchased included the name and the forward bookings. Since then the staff of Complete Caribbean have been working diligently to make contact with agents to assure them that their clients’ holidays have now been secured under the new ownership by ITC. In the main this has been well received although some agents, who had been trying to re-book their clients with other operators, appear to be a little unsure as to where the booking now belongs. Our lawyers firmly believe that all forward bookings belong to ITC unless written confirmation from the client requesting cancellation of the holiday has been received. In which case ITC cannot be held responsible for refunding any monies paid to Complete Caribbean for part or full payment of the holiday. Under no circumstances can an agent cancel the booking without a client letter confirming this. Furthermore under no circumstances may a hotel or airline assign over a forward booking made by Complete Caribbean to any other tour operator nor should an agent or tour operator request this. Of course the agent may request the exact same holiday for their client with any tour operator should they so wish but they must also abide by the aforesaid. Cancellation procedure or cancellation charges may be made. We hope this clarifies the position for those agents who have been unclear and we thank all those of you who have been affected by this occurrence for your understanding.
