Phil Wyatt wins right to appeal in Goldtrail case
Phil Wyatt, the former boss of collapsed operator XL Leisure, has won the right to appeal against last year’s court ruling that he illegally assisted the owner of Goldtrail to remove funds from the company before it went bust.
Wyatt and several of his associates were found to have provided ‘dishonest assistance’ to Abdulkadir Aydin prior to Goldtrail’s failure at the start of the peak summer season in 2010, which cost the Air Travel Trust Fund almost £25 million.
It took Goldtrail’s liquidators PwC four years to bring the case, which was heard last May.
Wyatt and two of his associates from his Black Pearl investment vehicle were ordered to pay back up to £1.4 million to Goldtrail’s creditors, of which the Civil Aviation Authority was the largest.
However, this week the Royal Courts of Justice gave them permission to appeal the decision.
