Southwest Airlines hit with flight cancellation lawsuit
The first consumer lawsuit was filed over Southwest Airlines flight cancellation meltdown.
The class-action lawsuit claims the airliner did not provide refunds to stranded passengers.
Plaintiff Eric Capdeville says Southwest breached its contract of carriage.
Capdeville says he was only offered a credit.
The contract states Southwest will pay flight cancellation refunds and compensate for hotels, food, and other transport.
“Southwest’s failure to provide prompt refunds violates its own contract and federal law,” the lawsuit stated.
Southwest ‘did not offer comparable accommodations on another flight,’ it said.
Refunds alone will cost Southwest about $5 million.
Southwest said it is making ‘high priority efforts’ to compensate customers.
