TUI pays settlement to sick holidaymaker

TUI had paid a £22,500 settlement to a client after her Egypt holiday was ruined by gastric illness.

Mandy Davis, 32, from Darlington, booked a 10-day stay at the Tropicana Rosetta and Jasmine Club resort in Sharm-el-Sheik with the tour operator in October 2013.

But according to law firm Irwin Mitchell, just days into her holiday with her former partner she began to suffer with diarrhoea, vomiting, stomach cramps and a fever.

As a result, the social worker lost a significant amount of weight and continues to suffer problems related to the illness 18 months on.

She told specialist travel lawyers at Irwin Mitchell that during her stay at the three-star resort she occasionally witnessed food on the buffet being exposed for long periods of time, sometimes noticed fresh food being added to old food and saw birds and flies in the restaurant while food was being prepared and served.

TUI UK admitted primary liability, but refused to comment on the settlement.

Jatinder Paul, an expert travel lawyer at Irwin Mitchell, who represented the holidaymaker, said: "Mandy’s case shows just how much of an impact an illness can have, as she continues to suffer with problems related to her illness almost 18 months after returning to the UK.

"She has been forced to alter her diet to reduce the frequency of these problems and we are now delighted to have secured a settlement for Mandy to cover the cost of her ruined holiday and the on-going problems she endures on a day-to-day basis.

"It is important that tour operators take note of this case and ensure that their customers’ health is protected by ensuring the hotels they are advertising have the appropriate hygiene standards.

"We are pleased to have agreed a fair settlement with TUI UK Ltd and we hope that Mandy will now be able to put her terrible ordeal behind her and continue her road to recovery after suffering such terrible symptoms."
