Delta sues DOT to save Aeromexico JV
Delta Air Lines and its joint venture partner Aeromexico have filed a legal challenge against the U.S. Transportation Department.
The DOT ordered the airlines to break up their business partnership due to what it says is Mexico’s anti-competitive stance over airport slots in Mexico City.
The DOT says the joint venture violates the existing Open Skies agreement with Mexico.
The airlines filed for a judicial review of the DOT’s order.
They are seeking to maintain their antitrust immunity so they can continue to coordinate schedules and pricing fir US-Mexico flights.
“We are inextricably one business in the transborder market operating for the benefit of US consumers. Unwinding the joint venture by the January 1 deadline would be operationally and financially burdensome,” Delta said.
It is ‘our only option at this point in time and procedurally the next step in the process to protect Delta’s and Aeromexico’s business interests,’ the airline added.
