First lawsuit filed by Amtrak passengers
One week after the Philadelphia Amtrak train crash, the first of what could be a long series of lawsuits has been filed by Amtrak passengers.
Four passengers on the derailed train filed a federal lawsuit for "serious and disabling" injuries against both Amtrak and the engineer of the train, Brandon Bostian, for negligence and recklessness.
The four passengers include two Spanish nationals Felicidad Redondo Iban and Maria Jesus Redondo Iban, a New Yorker and a resident of New Jersey.
In a separate action, train conductor Emilio Fonesca also filed a claim against Amtrak for undisclosed damages for negligence and carelessness.
Fonesca remains in hospital with broken bones and head trauma, his attorney said.
The May 12 derailment killed eight and injured more than 200 people.
Investigators said the train was travelling at 100 mph approaching a curve where the speed limit is 50 mph.
