Judge dismisses case against Qantas

A report in The Sydney Morning Herald says that a woman who tried to sue Qantas after she hurt her back putting her bags into a plane’s overhead locker has had her case dismissed.

Sophie Letherbarrow had been on QF2 from Bangkok to Sydney during April 2005 with two heavy bags containing a laptop, a printer and several files.

She claimed she did not have sufficient space to move in the aisle when lifting the bags upwards into the locker and could not do so without injuring herself.

She claimed Qantas had not informed her of its policy to limit the weight of hand luggage to 7kgs – her bags weighed 8.5 and 13.5kgs.

But this morning District Court judge Anthony Garling ruled her injury was not caused by “an unusual and unexpected event external to her” – the legal requirement for such claims, and should be dismissed.
