Orbitz sues former employees at G2
Orbitz filed a lawsuit against G2 Switchworks Corp. and five of G2’s officers and employees. All of the G2 defendants were former Orbitz employees.
The lawsuit was filed in the Circuit Court of Cook County and alleges that the G2 defendants breached their employment-related agreements with Orbitz, which includes having improperly taken and used Orbitz’s confidential information and trade secrets.
At least one current G2 employee has already admitted, in writing, that he “was in possession of and used sensitive documents.” That same G2 employee also confirmed that “[t]here is simply no excuse for my actions.”
Orbitz will vigorously protect the information it has spent vast resources to develop.
Orbitz filed this lawsuit to determine what additional information and other property the G2 defendants took from Orbitz, to prevent its further use by the G2 defendants, and to require its return to Orbitz.
G2 SwitchWorks Corp. responded by filing an action for declaratory relief in the Circuit Court of Cook County, Illinois, against Cendant Corp. and its wholly owned subsidiary Orbitz, Inc. G2 is requesting the Court declare that Alex Zoghlin, G2’s founder and CEO, and other members of G2’s management team, have not violated any contractual obligations to their former employer, Orbitz.
“G2 enjoyed a strong, collaborative working relationship with Orbitz executives, even prior to our inception in spring, 2004,” said Zoghlin. “The airlines that founded Orbitz and served on its board are G2 customers and I have personally made every effort to keep Orbitz’ management and counsel fully informed of G2’s commercial efforts.”
“When Cendant announced its acquisition of Orbitz in October, 2004, concerns were first raised that selected former Orbitz employees may have violated their non-compete and non-solicitation obligations,” added Zoghlin.
“G2 filed this motion today to reach clarity and resolution on these claims,” said Zoghlin.
