Southwest sued for passenger’s inflight fall and injury

Southwest Airlines is facing a lawsuit over an inflight injury sustained by a passenger.

Donnell Sims slipped and suffered injuries in the aisle on an ice cube dropped by a flight attendant, the suit claims.

He is seeking $200,000 in damages.

It happened on a flight from New York’s LaGuardia Airport to St. Louis

The plaintiff alleges the flight attendant dropped the ice cube and it slid down the aisle.

Sims slipped on it, causing neck and back injuries, he said in the complaint.

The flight attendant dropped the ice from a cup as she was collecting trash near the end of the flight.

At this time Sims got up to use the bathroom, the lawsuit claims.

He slipped and landed forcefully in the aisle.

He received medical attention from cabin crew and then was treated by medical staff after the plane landed.

He later went to hospital due to continued severe pain, it states.

The personal injury lawsuit alleges two counts of negligence for which he is seeking $100,000 for each.

The legal argument for negligence rests not on the dropped ice cube but on the flight attendant’s failure to pick it up.

Had it been picked up, the fall most likely would not have occurred, the filing says.
