Silverjet faces multi-million dollar lawsuit
Silverjet has vowed to fight a legal action by a US company which claims the airline failed to honour an agreement to provide it with a Boeing 767 aircraft.
In a stock market statement, Silverjet confirmed that it had received a legal complaint from C First Class Corp, but did not disclose details.
“Having taken legal advice, Silverjet remains of the opinion that the complaint is without merit,” said the statement.
C First Class Corp said it had filed a multi-million dollar lawsuit for damages against Silverjet in the New York Federal Court.
It claims it held an executed contract with FlyJet for the use of a dedicated 767-200ER aircraft and operation of an international charter programme.
But after Silverjet purchased FlyJet in November 2006, C First Class Corp said the airline subsequently “appropriated the dedicated 767 aircraft for its own purposes, including a deposit of €750,000, in direct violation and malicious disregard of all C First Class rights”.
It said SilverJet had agreed to provide alternative 767 ER aircraft, a break-up fee of €1 million and additional compensation, but has not honoured its agreement.
The lawsuit includes charges of unjust enrichment, tortious interference with a business relationship and tortious interference with contract.
